Mr Mark Ramprakash Divorce

Former England cricketer Mark Ramprakash has been granted a ‘quickie’ divorce from wife Valdana today.

Despite his six year affair with a Welsh single mother during their marriage, the couple were given a divorce on the ground of Vandana’s ‘unreasonable behaviour’.

District Judge Martin Berry granted a decree nisi  in central London today, with the couple agreeing to share custody of their two daughters.

Over in seconds: Mark Ramprakash, pictured with his now ex-wife Valdana last September, has been granted a quickie divorce

The couple, who married in 1993 and have two children, initially separated in December 2007 after trying to repair their marriage following news of the sportsman’s infidelities.

Despite repeated attempts to repair their marriage, the Surrey batsman, 40, admitted they had not lived together for the past six months.

Court papers said the marriage had ‘broken down irretrievably’ and Mrs Ramprakash had ‘behaved in such a way that the petitioner cannot reasonably be expected to live with the respondent’.

Valdana had admitted her unreasonable behaviour after being served divorce papers in May, but objected paying legal costs.

The US celebrity website TMZ spoke to a source with direct knowledge of the settlement and said she would get “close to” nine figures.

The amount is more than she would have received under a prenuptial agreement which was believed to have given Miss Nordegren the right to $20 million (£12 million) after 10 years of marriage.

However, it would be less than the largest divorce settlement in celebrity history, the $150m (£100 million) paid by Michael Jordan, the basketball star, to his former wife Juanita.

According to Forbes magazine Woods is worth a total of around $600 million (£400 million.)

Both Woods and Miss Nordegren are believed to have wanted to avoid an “ugly” public divorce.

The central issue in negotiations has been to ensure that both have access to their two children Sam, 3, and Charlie, 15 months.

Woods’ private and professional life imploded in November after he crashed his car into a tree outside his home in Florida in the early hours of the morning.

The crash was said to have followed an argument with his wife over his marital infidelities, and a string of women then came forward alleging affairs.

In February he admitted being unfaithful and said he had been “selfish and stupid.

I want to get a divorce but have no idea where my ex is?

This is a question we often get asked.

The most common reason is that people have simply moved on and it has been a number of years since the couple have had any communication.

This procedure is most common with 5 year separation divorce petitions.

For couples where the errant spouse is a UK citizen.

Where both parties are UK citizens we would have to apply to the court for what is known as a disclosure order against HM Revenue and Customs. This order has to be filed in either the High Court or in a County Court where the court has High Court jurisdiction.

Ideally we will need the spouse’s full name, last known address, date of birth and National insurance number or a combination of the above, with the date of birth being mandatory.

The Judge then makes an order against HMRC and they have 21 days to respond. HMRC will look through their database to identify if your spouse has an address in the UK.

If your spouse is identified HMRC will send the details to the court who will then send the divorce petition to the address given. You will not be able to see this address as it remains confidential.

If your spouse then fails to reply, you can apply for the decree nisi as the service of the petition to your spouse by the court is considered good service.

Couples where the errant spouse is not a UK citizen or has not been heard of for a long time.

For couples whose spouse is not a UK citizen or they have no information about them they can apply to dispense with service of the petition. This means that the court will order that the petition does not need to be served on the respondent.

In the application you have to give as much information as to what you know about the respondent to ensure that making the order is in the interests of justice.
For instance if you know where they work, or their bank account or have details of their relatives, you must inform the court as it may be more beneficial to have documents served at their addresses.

The application is on oath so you must tell the truth or could face a perjury charge if you lie.

Each application made costs £40.00 in court fees in addition to the divorce petition

A study has found that 3% of divorces filed in England and Wales are divorces where the couple have separated after less than one year of marriage.

The firm that carried out the study has dubbed these divorces “flash divorces” as they happen as quickly as the marriage began.

Mark Keenan the founder and Managing Director of Divorce-Online who carried out the study believes that the majority of these “flash divorces” result from “flash marriages” where the couple getting married have known each other for less than a year.

He said “By reading through a decent sample of divorce petitions I could see that the common thread was that a lot of the couples had married quickly after meeting which would suggest that there is a pretty strong correlation between the speed at which you get married and the likely hood of a “flash divorce” happening not too soon thereafter”.

82% percent of the petitions were filed on the fact of unreasonable behaviour and the remainder were for adultery.

Angelique Naylor and Sabina Daly married in Massachusetts in 2004, the year it became the first state to let same-sex couples tie the knot.

However, the couple then moved together to Texas and when things started to fall apart and Miss Naylor applied for a divorce, she hit a legal stumbling block.

She is now fighting the state of Texas, which says a union granted in a US state where same-sex marriage is legal can’t be dissolved with a divorce in a state, such as Texas, where it’s not.

Miss Naylor says she did not file for divorce as an equal rights statement – she just wants to get on with her life.

“We didn’t ask for a marriage; we simply asked for the courtesy of divorce,”

Gay and lesbian couples who turn to the courts when they break up are getting mixed results across the nation. A Pennsylvania judge last month refused to divorce two women who married in Massachusetts, while New York grants such divorces even though the state doesn’t allow same-sex marriage. Connecticut, Iowa, New Hampshire, Vermont and the District of Columbia now also allow same-sex marriage.

“The bottom line is that same-sex couples have families and their families have the same needs and problems, but often don’t have the same rights,” said Jennifer Pizer, a lawyer for Lambda Legal, a national legal organization that promotes equal rights for gay, lesbian, bisexual and transgender people.

A judge in Austin granted Miss Naylor and Miss Daly, who have a four-year-old son, the divorce, but Texas Attorney General Greg Abbott is appealing the decision. He also is appealing a divorce granted to an unnamed gay couple in Dallas, saying protecting the “traditional definition of marriage” means doing the same for divorce.

Mr Abbott, a Republican seeking re-election, has argued in court filings that because the state doesn’t recognise same-sex marriage there can be no divorce, but a gay or lesbian Texas couple may have a marriage voided. Attorneys representing such couples argue that voiding a marriage here could leave it intact in other states, creating problems for property divisions and other issues.

Miss Naylor and Miss Daly separated in 2007 and have had to try to work out how to split their business and home along with custody arrangements for their son.

Cheryl Cole is unlikely to cite estranged husband Ashley’s alleged adultery as the reason for their divorce, a report has claimed.

The X Factor judge is expected to only focus on the sex texts that her partner has been accused of sending, meaning that the grounds for divorce will instead be “unreasonable behaviour”, according to the Daily Mail.

It is thought that the Girls Aloud star has been told that Ashley’s reported infidelity would be “more difficult for her to prove” as the Chelsea footballer is unlikely to formally admit any wrongdoing.

Cheryl is reportedly being advised by Fiona Shackleton, who has represented both Prince Charles and Sir Paul McCartney in the past. The singer has now been tipped to get the divorce over as quickly as possible and is expected to secure a straight split of the assets she shares with Ashley.
